Disciplinary Actions

The North Carolina Auctioneer Licensing Board does not provide information in reference to complaints against licensees. All formal complaints are fully investigated and the Board makes the determination as to whether there is probable cause that a violation(s) of the North Carolina Auctioneers Law or Rules have occurred. When the Board has made a determination that a violation(s) has occurred, it then decides if disciplinary action is needed.

The North Carolina Auctioneer Licensing Board defines "disciplinary actions" against a licensee, as a letter of reprimand, assessment of a civil penalty, a suspension of a license, a voluntary surrender of a license, and a revocation of a license. The Board’s policy is to post this information on this web site as follows:

1) For Letters of Reprimand, the posting would be for a time period of one (1) year after acceptance of the Letter; 2) For Assessments of Civil Penalties, the posting would be for a time period of two (2) years after the payment of a civil penalty; 3) For Suspension of a License, the posting would be for a time period of three (3) years after a suspension is completed; and, 4) For Voluntary Surrender of a License and the Revocation of a License, the posting would be indefinitely.

Information in reference to a licensee’s previous disciplinary actions can be obtained by providing a request to the Board’s office in writing.

Allen, Zachary G. NCAL# 9606 Polkton, NC Pursuant to a Consent Order, licensee Zachary G. Allen received a thirty (30) day suspension for violations of N.C.G.S. 85B-7(b) regarding consignment records and N.C.G.S. 85B-7(d) regarding sales records. The suspension was abatable to zero (0) days suspension if Mr. Allen successfully completed certain educational conditions and paid a civil penalty in the amount of $500.00 prior to March 1, 2022. The conditions were met, and the suspension was fully abated on February 10, 2022. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.
Ammons, Benjamin J. NCAL# 6581 Linden, NC Pursuant to a Consent Order entered into between the licensee (dba Ammons Auctions) and the Board, Benjamin Ammons paid a civil penalty in the amount of $250.00 and received a Letter of Reprimand for violation of NCGS 85B-7.1(a) regarding settlement statement signatures. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards. The effective date of the Consent Order was May 13, 2024.
Andrus, P. Spencer NCAL# 9612 Elizabeth City, NC Pursuant to a Consent Order entered into between the licensees and the Board, licensees Corner Market Auctions, Spencer Andrus, and Melyssa Durren paid a civil penalty in the amount of $100.00 and received a Letter of Reprimand for violation of 21 NCAC 04B .0405(b) involving civil lawsuit reporting requirements. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards. The effective date of the Consent Order was July 8, 2024.
Associated Auction & Liquidation Co NCAL# 10275 Yuma, TN Pursuant to a Consent Order entered into between the licensee and the Board effective February 13, 2023, Associated Auction & Liquidation Co. was assessed a Civil Penalty of $1,000.00 and received a license Suspension for a period of twelve (12) months for violations of 21 NCAC 04B .0606(b) Only Board-approved designated person(s) for an auction firm shall have the authority to transact business under the firm license; NCGS 85B-7.1(a) All settlement statements shall be signed by the licensee or the licensee's agent and by the person receiving the disbursement; and NCGS 85B-4(a) for conducting an auction while in the firm's license was in Lapsed status. The period of Suspension was abatable to zero (0) months if the Designated Person for the licensee took and passed the NCALB Auction Firm Examination prior to March 15, 2023. The licensee's Designated Person took and passed the NCALB Auction Firm Examination prior to March 15, 2023, and the license Suspension was abated from twelve (12) months to zero (0) months. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.
ATM Auction & Realty, LLC NCAL# 10321 Monroe, NC Pursuant to a Consent Order entered into between the licensees and the Board, Aaron T. Maye and ATM Auction & Realty, LLC received ninety (90) day suspensions for violations of 21 NCAC 04B .0604(g) involving buyer's premium not authorized by consigning sellers, and 21 NCAC 04B .0605(a) involving licensee/licensee employees placing bids in an auction without announcing that activity to all bidders. The suspensions were abatable to zero (0) days suspensions if Mr. Maye took and passed the NC Auction Firm Examination and paid a civil penalty to the Board in the amount of $1,000.00 prior to September 1, 2023. The conditions were met, and the suspensions were fully abated on August 10, 2023. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.
Auctions Worldwide, Inc NCAL# 7672 Milford, CT Effective April 11, 2005, Auctions Worldwide, Inc.'s auction firm license was revoked for one violation of making a false statement or giving any false information in connection with an application for renewal of a license; for four violations of failing to properly make disclosures required by 21 NCAC 4B .0405; for four violations of failing to report in writing to the Board any and all civil suits involving them that are based upon any allegation of gross negligence, dishonesty, fraud, misrepresentation or incompetency, or that in any way involve an auction sale or a transaction related to an auction matter or auctioneering; and for one violation of failing to notify the Board in writing of each change or addition of residence or business address within 10 days of the occurrence of such change. Beshara, Christopher NCAL# 7443 Newton, NC Effective October 1, 2010, Christopher Beshara's auctioneer license was permanently revoked for failure to pay for or return unsold property. This is a violation of G.S. 85B-7.1(a),(b);21 NCAC 4B.0404(a)(11); 21 NCAC 4B.0404(a)(12). Mr. Beshara waived his right to appeal as allowed by law and agreed to the Board`s findings of violations.
Beshara, Christopher NCAL# 7443 Newton, NC Effective October 1, 2010, Mr. Beshara's auctioneer's license was permananetly revoked for failure to pay consigner for items sold. This is a violation of G.S. 85B-7(b),(d); G.S.85B-7.1(a),(b); G.S. 85B-8(a)(3); G.S. 85B-8(a)(7); G.S. 85B-8(a)(10); 21 NCAC 4B.0404(a)(11); 21 NCAC 4B.0603(a),(c); 21 NCAC 4B.0604(a),(c),(e),(f),(g). Mr. Beshara waived his right to appeal as allowed by law and agreed to the Board`s findings of violations.
Black Cat & White Dog Auction  NCAL# 6229 Benson, NC Black Cat & White Dog Auction's auction firm license was revoked for conducting an auction in this State without first having a written agreement with the owner of the property to be sold; for failing to maintain consignment records; for failing to maintain sales records; for failing to maintain a trust or escrow account and for failing to deposit in the account all funds that are received for the benefit of another person that is not disbursed to the seller on auction day; for failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensee's possession through an auction sale; for commingling the funds or property of a client with the licensee's own or failing to maintain and deposit in a trust or escrow account in an insured bank or savings and loan association located in North Carolina funds received for another person through sale at auction; for failing to deposit in an escrow account funds within three business days after receipt of same; for failing to prepare a receipt or settlement statement in compliance of G.S. 85B-7.1(a) and maintain records in compliance with G.S. 85B-7.1(b); and for failing to establish and maintain a custodial account for sellers proceeds. Jane F. Cook waived her right to appeal as allowed by law and agreed to the Board's findings of violations.
Blanton's Auction House NCAL# 9497 Laurinburg, NC Effective September 19, 2014, Blanton's Auction House License was revoked for violation of the following: G.S. 85B-4(g) An auction firm must be licensed by the Board even though no owner or officer of the firm acts as an auctioneer; G.S. 85B-7(a) No licensee shall conduct an auction in this State without first having a written agreement with the owner of any property to be sold; G.S. 85B-8(a)(2) A continued and flagrant course of misrepresentation or making false promises, either by the licensee, an employee of the licensee, or by someone acting on behalf of and with the licensees consent, (3) Any failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensees possession through an auction sale, and (10) Failure to properly make any disclosures or to provide documents or information required by this Chapter or by the Commission; 21 NCAC 4B .0405(b) All auctioneers, apprentice auctioneers and auction firms, including their principals and designated person(s), shall report to the Board any and all civil suits involving them that are based upon any allegation of gross negligence, dishonesty, fraud, misrepresentation or incompetency, or that in any way involve an auction sale or a transaction related to an auction matter or auctioneering. The Board must receive written notice of any such civil suit within 30 days of the date the complaint in the suit is served on the defendant in the action, or the date a pleading containing one or more of these allegations is served on a party; and, 21 NCAC 4B .0601(a) All licensees shall notify the Board in writing of each change or addition of residence or business address (including mailing address) and change of trade name, assumed name, or combination of names under which the licensee conducts business related to auctions. Blanton's Auction House waived its right to appeal as allowed by law and agreed to the Board's findings of violations.
Booth, Michael L. NCAL# 2349 Boifay, FL Effective October 8, 2001, Mr. Booth voluntarily surrendered his North Carolina auctioneer license. This action resulted from Mr. Booth failing to report to the Board any and all criminal arrests for, charges of or convictions of misdemeanors that have as an essential element dishonesty, deceit, fraud, or misrepresentations, or any arrests, charges or convictions of any felonies and for failing to possess truth, honesty and integrity sufficient to be entitled to the high regard and confidence of the public. A Settlement Agreement and Consent Order were entered into between the Board and Mr. Booth, prior to a scheduled hearing, in which he agreed to the above stipulations. Mr. Booth admitted to the Board`s findings of violations.
Bostic, Misti Leigh NCAL# 8746 Concord, NC Effective February 20, 2012, Misti Leigh Bostic's auctioneer license was permanently revoked for failure to pay the seller for items sold at auction; failure to pay the seller in a timely fashion; and Ms. Bostic demonstrates a lack of financial responsibiity. This is a violation of N.C.G.S. 85B-4(a), N.C.G.S. 85B-8(a)(10) and (11) and 21 NCAC 4B.0404(a)(12). Ms. Bostic waived her right to appeal as allowed by law and agreed to the Board`s findings of violations.
Broker Arch Auction, LLC NCAL# 9399 Weaverville, NC Pursuant to a Consent Order entered into between the licensees and the Board, licensees Travis Wilson and Broken Arch Auction, LLC paid a civil penalty in the amount of $750.00 and received a Letter of Reprimand for violation of NCGS 85B-7.1(a) regarding settlement statement signatures, 21 NCAC .04B .0604(g) involving buyer's premium not authorized by consigning sellers, and 21 NCAC 04B .0605(a) involving licensee/licensee employees placing bids in an auction without announcing that activity to all bidders. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards. The effective date of the Consent Order was April 8, 2024.
Buell, Jesse B. NCAL# 5858 Williamston, NC Effective January 18, 2000, Jesse Buell's auctioneer license was suspended indefinitely for failing to report federal felony indictments. Following an investigation into this matter, the Board found probable cause to suspend or revoke Jesse Buell`s auctioneer license and referred the matter to the Office of Administrative Hearings as prescribed by Chapter 150B. Jesse Buell failed to respond as required and the Board suspended Jesse Buell's license indefinitely as allowed by law.
Caring Transitions of Chapel Hill   NCAL# 10589 Durham, NC Pursuant to a Consent Order entered into between the licensee and the Board effective April 8, 2024, Refined Spaces NC, LLC (dba Caring Transitions of Chapel Hill) was assessed a civil penalty of $500.00 and received a license Suspension for a period of sixty (60) days for violations of NCGS 85B-4(a) conducting an auction while the firm's license was in Lapsed status, NCGS 85B-7.1(a) regarding settlement statement signatures, 21 NCAC 04B .0603(a) regarding custodial account use, 21 NCAC .04B .0604(g) involving buyer's premium not authorized by consigning sellers in a written auction contract, and 21 NCAC 04B .0605(a) involving licensee/licensee employees placing bids in an auction without announcing that activity to all bidders. The period of Suspension was abatable to zero (0) days if the Designated Person for the licensee took and passed the NCALB Auction Firm Examination prior to June 1, 2024. The licensee's Designated Person took and passed the NCALB Auction Firm Examination prior to June 1, 2024, and the license Suspension was abated from sixty (60) days to zero (0) days. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.
Complete Auctions, LLC dba Gibsonville Auction House  NCAL# 10195 Gibsonville, NC Pursuant to a Consent Order entered into between the licensee and the Board, Complete Auctions, LLC received a six (6) month suspension and was assessed a civil penalty in the amount of $1,000.00 for violations of N.C.G.S. 85B-4(a) involving auction activity conducted while license was in Lapsed status, N.C.G.S. 85B-7.1(a) involving signed settlement statements, and 21 NCAC 04B .0604(g) involving buyer's premium not authorized by consigning sellers. The suspension was abatable to zero (0) days suspension if the licensees Designated Person took and passed the NC Auction Firm Examination and paid a civil penalty to the Board in the amount of $2,000.00 (rather than $1,000.00) prior to August 15, 2023. Crain, Frank N. NCAL# 4937 Elizabethtown,KY Effective July 25, 2003, Mr. Crain's auctioneer license was revoked for failure to notify the Commission of the surrender of a license in the person`s resident state within ten days of occurence as required; for making any false statement or giving any false information in connection with an application for renewal of a license; and for failure to report to the Board any and all administrative proceedings which are commenced against them which involve any potential revocation or suspension of, or other disciplinary action against, any auctioneer license that they hold in another state within thirty days. Frank Crain waived his right to appeal as allowed by law and agreed to the Board`s findings of the violations.
Deen, Robert Eugene  NCAL# 9520 Oak City, NC Robert Eugene Deen voluntarily surrendered his auctioneer license effective March 6, 2020.
Dodgen, Grover Daryl  NCAL# 6825 Greenwood, SC Effective February 10, 2011, Mr. Dodgen's auctioneer's license was revoked for failure to sign a contract and to pay for items sold at auction. This is a violation of G.S.85B-7(a),G.S. 85B-7.1(a) and (b) and G.S. 85B-8(a)(3) and (7). Mr. Dodgen waived his right to appeal as allowed by law and agreed to the Board`s findings of violations.

Eanes, James Jeffrey NCAL# 7818 Eden, NC James Jeffrey Eanes voluntarily surrendered his auctioneer license effective July 25, 2024.
East Coast Finanical, Inc. NCAL# 8995 Chamblee, GA Effective February 14, 2011, Mr. Levinsohn voluntarily permanently surrendered his North Carolina auction license. This action resulted from Mr. Levinsohn's newspaper advertisements about "Bernie Madoff Auctions" which were believed to be false and misleading. This is a violation of G.S. 85B-8(a)(2) and (4); 21 NCAC 4B.0404(a)(6)(B); and 21 NCAC 4B.0604(a).
Emanuel, Jr., Kenneth Mac  NCAL# 10203 Shallotte, NC Kenneth Mac Emanuel, Jr. voluntarily surrendered his auctioneer license effective May 20, 2022.
Ervin, R. Danny NCAL# 1007 Mooresville, NC Effective September 10, 2001, R. Danny Ervin's auctioneer license was revoked for selling, or offering to sell, goods or real estate at auction in this State or perform any act for which an auction firm license is required without a currently valid license issued under N.C.G.S 85B; for not possessing an auction firm license; and for violating any order of the Auctioneer Licensing Board requiring a licensee to comply with any provision of the Board's law or administrative rules. Mr. Ervin did not appeal the Revocation of his auctioneer license as allowed by law and agreed to the Board`s findings of the violations.
Estate Galleries  NCAL# 9380 Raleigh, NC Effective March 11, 2013, Estate Galleries auction firm license was permanently revoked for violation of G.S. 85B-4(g); G.S 85B-7(a)and (b); G.S. 85B-7.1(a) G.S. 85B-8(a)(2),(3),(5),(7), and (10); 21 NCAC 4B.0404(a)(6)(A) and (11); 21 NCAC 4B.0602(a); and, 21 NCAC 4B.0606(b). An Administrative Hearing was held on February 11, 2013, N.C. Auctioneer Licensing Board vs. Estate Galleries. Garris Neal Yarborough, the Board's Legal Counsel presided at the hearing and the respondent, Gary Louis Nadel, elected to proceed pro se. On March 11, 2013 the Board adopted the Proposed Findings of Fact and Conclusions of Law submitted by Board Counsel and revoked the auction firm license of Estate Galleries.
Franklin Auction, Inc.   NCAL# 10192 Franklin, NC Gregory Edward Vernelson voluntarily surrendered his auctioneer license and the auction firm license for Franklin Auction, Inc., effective July 30, 2019.
Godwin, George S NCAL# 5351 Spring Hope, NC Effective August 10, 2015, George S. Godwin's auctioneer license was revoked violation of NCGS 85B-7 No licensee shall conduct an auction in this State without first having a written agreement with the owner of any property to be sold. The agreement must contain the terms and conditions upon which the auctioneer received the goods for sale. The licensee shall provide the owner with a signed copy of the agreement and shall keep at least one copy for this own records for two years from the date of the agreement. Copies of all contracts shall be made available to the Commission or its designated agent upon request; NCGS 8B-8(a)(3) Any failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensees possession through an auction sale; and, NCGS 85B-8(a)(10) Failure to properly make any disclosures to provide documents or information required by this Chapter or by the Commission. Mr. Godwin waived his right to appeal as allowed by law and agreed to the Board`s findings of violations.
Grandeur Luxury Auctions Inc. NCAL# 10019 Davidson, NC Grandeur Luxury Auctions Inc. voluntarily surrendered its auction firm license effective January 18, 2017.
Hall, Troy L.  NCAL# 4703 Elkin, NC Pursuant to a Consent Order entered into between the licensee and the Board, the Auctioneer license of Troy L. Hall was suspended for a period of one (1) year, effective June 15, 2022 for a violation of 21 NCAC 04B .0604(g) In auctions of consigned property, any buyer's premium shall be calculated, collected, and distributed according to terms authorized by the consignor in a written auction contract, a violation of 21 NCAC 04B .0604(e) regarding bidder registration records, and a violation of G.S. 85B-7(d) regarding sales records, as well as additional auction irregularities. Pursuant to a Settlement Agreement entered into between the licensee and the Board on June 28, 2023, Troy L. Hall was assessed a Civil Penalty of $800.00 and received a Letter of Reprimand for issues occurring during the period that his Auctioneer license was in suspended status from June 15, 2022 to June 15, 2023. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.
Heller, Thomas B. NCAL# 6043 Stuart, FL Effective April 10, 2000, Thomas Heller's auctioneer license was revoked indefinitely for failing to account for or to pay within a reasonable time funds that belong to another; for acts of conduct in connection with a sales transaction which demonstrates bad faith or dishonesty; and for failing to possess truth, honesty and integrity sufficient to be entitled to the high regard and confidence of the public. Following an investigation into this matter, the Board found probable cause to revoke Thomas B. Heller's auctioneer license and referred the matter to the Office of Administrative Hearings as prescribed by Chapter 150B. Thomas Heller failed to respond as required and the Board revoked Thomas Heller's license indefinitely as allowed by law.

A Settlement Agreement and Consent Order were entered into between the Board and Edgar H. Maxwell prior to a scheduled hearing, in which he agreed to the above stipulations. Edgar H. Maxwell admitted to the Board's findings of violations.
Maye, Aaron T.  NCAL# 9349 Monroe, NC Pursuant to a Consent Order entered into between the licensees and the Board, Aaron T. Maye and ATM Auction & Realty, LLC received ninety (90) day suspensions for violations of 21 NCAC 04B .0604(g) involving buyer's premium not authorized by consigning sellers, and 21 NCAC 04B .0605(a) involving licensee/licensee employees placing bids in an auction without announcing that activity to all bidders. The suspensions were abatable to zero (0) days suspensions if Mr. Maye took and passed the NC Auction Firm Examination and paid a civil penalty to the Board in the amount of $1,000.00 prior to September 1, 2023. The conditions were met, and the suspensions were fully abated on August 10, 2023. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.
McCoon, Jason R. NCAL# 8690 Raleigh, NC Effective January 12, 2015, Jason R. McCoon's auctioneer license #8690 was permanently revoked for the following violations: NCGS 85B-7(a) No licensee shall conduct an auction in this State without first having a written agreement with the owner of any property to be sold. The agreement must contain the terms and conditions upon which the auctioneer received the goods for sale. The licensee shall provide the owner with a signed copy of the agreement and shall keep at least one copy for his own records for two years from the date of the agreement. Copies of all contracts shall be made available to the Commission or its designated agent at reasonable times; NCGS 85B-7.1(a) At or before the time of all final settlements, the auctioneer shall provide the seller or consignor with a settlement statement, which includes a description of all goods sold, the selling price of the goods sold, the net proceeds due to the seller or consignor, the name and address of the person receiving the disbursement, and the amount of the disbursement. All settlement statements shall be signed by the licensee or the licensees agent and by the person receiving the disbursement; NCGS 85 B-8(a)(2) A continued and flagrant course of misrepresentation or making false promises, either by the licensee, an employee of the license, or by someone acting on behalf of and with the licenses consent; NCGS 85B-8(a)(3) Any failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensees possession through an auction sale; NCGS 85B-8(a)(7) Commingling the funds or property of a client with the licensees own; NCGS 85B-8(a)(10) Failure to properly make any disclosures or to provide documents or information required by this chapter or by the Commission; and, 21 NCAC 4B .0603(e) The Custodial Account for Sellers shall be drawn on only for payment of: 1-the net proceeds to seller, 2-lawfull charges against the property, and, 3-to obtain any sums due the auctioneer. Mr. McCoon made an appeal to the Board in the established time as allowed by Law. An Administrative Hearing was held on December 8, 2014, N.C., Auctioneer Licensing Board vs. Jason R. McCoon, the Board's Legal Counsel presided at the hearing and the respondent, Jason R. McCoon, elected to proceed pro se. On January 12, 2015 the Board adopted the Proposed Findings of Fact and Conclusions of Law submitted by Board Counsel and revoked the auctioneer license of Jason R. McCoon.
McDonald, Cheryl M. NCAL# 6456 Wilmington, NC Effective March 1, 2002, Cheryl M. McDonald's auctioneer license was suspended indefinitely for failing to maintain accounting records, for failing to maintain records which identify the purchaser of all goods sold, for failing to completely cooperate with any investigation, for making any false statement or giving any false information in connection with any investigation by the Board or the Board`s designee, for engaging in unprofessional conduct, and for violating any order of the Auctioneer Licensing Board requiring a licensee to comply with any provision of the Board's law or administrative rules. Following an investigation into this matter, the Board found probable cause to suspend or revoke Cheryl McDonald`s auctioneer license. Cheryl McDonald failed to appeal the Board's decision and the Board suspended Cheryl McDonald`s license indefinitely as allowed by law.

Rudisill received a thirty (30) day suspension for violations of N.C.G.S. 85B-7.1(a) no signed settlement statement and 21 NCAC 04B .0604(g) regarding buyer's premium authorization. The suspension was abatable to zero (0) days suspension if Mr. Rudisill successfully completed certain educational conditions and paid a civil penalty in the amount of $750.00 prior to September 1, 2022. The conditions were met, and the suspension was fully abated on August 26, 2022. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards.

Second (2nd) Chance Furniture  NCAL# 9400 Bunn, NC Effective April 13, 2015, 2nd Chance Furniture's Auction Firm License #9400 was revoked for the following; failure to sign an auction contract, failure to pay seller for property sold at auction, and failure to respond to complaint. This is a violation N.C.G.S. 85B-7(a) and N.C.G.S. 85B-8 (a)(10).
Sigmon, James T.  NCAL# 6012 Stanley, NC Effective December 22, 1999, Mr. Sigmon's auctioneer license was suspended indefinitely for failing to notify the Board of two felony warrants, for falsely answering statements on renewal applications, for providing a check for renewal on a closed account and for failing to provide documents or information required by the Board. Following an investigation into this matter, the Board found probable cause to suspend or revoke Mr. Sigmon's auctioneer license and referred the matter to the Office of Administrative Hearings as prescribed by Chapter 150B. Mr. Sigmon failed to respond as required and the Board suspended Mr. Sigmon's license indefinitely as allowed by law.
Smith, Eric H.  NCAL# 7565 Reidsville, NC February 26, 2005, Mr. Smith's auctioneer license was revoked for failure to properly make any disclosures or to provide documents or information required by this Chapter or by the Commission; for failure to completely cooperate with any investigation; and for engaging in unprofessional conduct. Eric Smith waived his right to appeal as allowed by law and agreed to the Board's findings of the violations.

Pursuant to formal complaints having been filed prior to the license surrender and as a result of the completed investigation, the Board found that probable cause existed to find that the licensee violated NCGS 85B-8(a)(3) Any failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensees possession through an auction sale, and that the licensee violated NCGS 85B-8(a)(10) Failure to properly make any disclosures or to provide documents or information required by this Chapter or by the Commission, which would have substantiated a disciplinary finding of revocation, but for the license having been previously surrendered.
Tony Quarles Enterprises  NCAL# 6830 Harrisburg, NC Effective May 24, 2011, Tony Quarles Enterprises' auction firm license was revoked for conducting an auction in this State without first having a written agreement, for failing to maintain consignment records; for failing to maintain sales records; for failing to maintain a trust or escrow account and for failing to deposit in the account all funds that are received for the benefit of another person that is not disbursed to the seller on auction day; for failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensee's possession through an auction sale; for failing to prepare a receipt or settlement statement. This is in violation of G.S. 85B-7(a) G.S., 85B-7.1(a)(b), and G.S. 85-8(a)(3) and (7). Tony Quarles waived his right to appeal as allowed by law and agreed to the Board's findings of violations.
Tory Hill Auction Co.  NCAL# 8707 Raleigh, NC Effective January 12, 2015, Tory Hill Auction Company's auction firm license NCAL #8707 was permanently revoked for the following violations: NCGS 85B-7(a) No licensee shall conduct an auction in this State without first having a written agreement with the owner of any property to be sold. The agreement must contain the terms and conditions upon which the auctioneer received the goods for sale. The licensee shall provide the owner with a signed copy of the agreement and shall keep at least one copy for his own records for two years from the date of the agreement. Copies of all contracts shall be made available to the Commission or its designated agent at reasonable times; NCGS 85B-7.1(a) At or before the time of all final settlements, the auctioneer shall provide the seller or consignor with a settlement statement, which includes a description of all goods sold, the selling price of the goods sold, the net proceeds due to the seller or consignor, the name and address of the person receiving the disbursement, and the amount of the disbursement. All settlement statements shall be signed by the licensee or the licensees agent and by the person receiving the disbursement; NCGS 85 B-8(a)(2) A continued and flagrant course of misrepresentation or making false promises, either by the licensee, an employee of the license, or by someone acting on behalf of and with the licenses consent; NCGS 85B-8(a)(3) Any failure to account for or to pay over within a reasonable time, not to exceed 30 days, funds belonging to another which have come into the licensees possession through an auction sale; NCGS 85B-8(a)(7) Commingling the funds or property of a client with the licensees own; NCGS 85B-8(a)(10) Failure to properly make any disclosures or to provide documents or information required by this chapter or by the Commission; and, 21 NCAC 4B .0603(e) The Custodial Account for Sellers shall be drawn on only for payment of: 1-the net proceeds to seller, 2-lawfull charges against the property, and, 3-to obtain any sums due the auctioneer. An Administrative Hearing was held on December 8, 2014, N.C. Mr. McCoon made an appeal to the Board in the established time as allowed by Law. Auctioneer Licensing Board vs. Tory Hill Auction Co., the Board's Legal Counsel presided at the hearing and the respondent, Jason R. McCoon, elected to proceed pro se. On January 12, 2015 the Board adopted the Proposed Findings of Fact and Conclusions of Law submitted by Board Counsel and revoked the auction license Tory Hill Auction Co.
Varsha, Alon   NCAL# 5889 Van Nuys, CA Effective November 1, 1999, Alon Varsha's auctioneer license was suspended indefinitely for falsely answering statements on an initial application, for falsely answering statements on renewal applications and for failing to provide documents or information required by the Board. Following an investigation into this matter, the Board found probable cause to suspend or revoke Alon Varsha's auctioneer license and referred the matter to the Office of Administrative Hearings as prescribed by Chapter 150B. Alon Varsha failed to respond as required and the Board suspended Alon Varsha's license indefinitely as allowed by law.

NCAL# 5453 Raleigh, NC Effective May 25, 2002, Randolph White's auctioneer license was suspended indefinitely for failure to completely cooperate with an investigation; for violating an order of the Auctioneer Licensing Board requiring him to comply with provisions of the Board's law or administrative rules; and for engaging in unprofessional conduct. Following an investigation into this matter, the Board found probable cause to suspend or revoke Randolph White's auctioneer license and referred the matter to the Office of Administrative Hearings as prescribed by Chapter 150B. Randolph White failed to respond as required and the Board suspended Randolph White's license indefinitely as allowed by law.

Travis NCAL# 9739 Weaverville, NC Pursuant to a Consent Order entered into between the licensees and the Board, licensees Travis Wilson and Broken Arch Auction, LLC paid a civil penalty in the amount of $750.00 and received a Letter of Reprimand for violation of NCGS 85B-7.1(a) regarding settlement statement signatures, 21 NCAC .04B .0604(g) involving buyer's premium not authorized by consigning sellers in a written auction contract, and 21 NCAC 04B .0605(a) involving licensee/licensee employees placing bids in an auction without announcing that activity to all bidders. Per the provisions of N.C.G.S. 85B, all collected civil penalties are forwarded to local school boards. The effective date of the Consent Order was April 8, 2024.
